What applies to the renewal of the residence document under 18 (4) of Withdrawal Agreement? What supporting documents are needed for this purpose?

All applicants are required to provide to the competent authorities the following common supporting documents:

  • Application form, which is issued by the competent police Authority.
  • Passport or travel document in force, officially recognized by Greece.
  • Four (4) current color photographs in natural form, with the same technical specifications as those of passports, as they apply each time.
  • Sixteen (16) euros e-Administrative fee (e-Παράβολο). Τhe e-Administrative fee is available on the website of the General Secretariat of Information Systems of Public Administration (https://www1.gsis.gr/sgsisapps/eparavolo/public/welcome.htm) as below:

Notice: The payment of the e-Administrative fee is required in order to be submitted to the competent Authority. Unpaid e-Administrative-fees are not accepted by the competent Authority.

  • Previous residence document under 18 par. 4 of the WA.
  • Document-s that prove the residence address of the applicant in the Greek territory. For the list of documents that can be submitted for this purpose, click here.
  • Those who had not acquired the right of permanent residence when they were issued the residence document for first time, they should prove that they continued to reside in the Greek territory, in accordance with the conditions set out in the Directive 2004/38 / EC continuously (Articles 11 and 13 of the WA)for the period until the acquisition of the right of permanent residence right. The fulfillment of the above conditions has as a result to be proved at the same time that the conditions of their continuous and legal residence, for the purpose of acquiring the right of permanent residence (Article 15 of the WA). Ιt is noted that the period of continuous and legal residence, according to the Union law, before the end of the transition period, is included in the calculation of the qualifying period necessary for acquisition of the right of permanent residence (Article 16 of the WA).

For example, a UK national resided in Greece under Union law as an economically inactive person from the beginning of 2019 and was issued in early 2021 the residence document under article 18 par. 4 WA valid for five years, as not having the right of permanent residence. If the applicant at the beginning of 2026 apply for the renewal of this document, he/she will simply have to prove that he/she fulfilled the conditions of continuity of residence under article 11 of the WA and of the right of residence under article 13 of the WA, as an economically inactive person (unless he/she has changed their status) for each of the remaining three years (ie from 2021 to 2024), as at the same time the conditions of continuous and legal residence for the acquisition of the right of permanent residence under article 15 of the WA are met. This means that the applicant should prove for this period of residence that he/she has had sufficient resources for himself/herself and his/her family members not to become a burden on the social assistance system of Greece and  comprehensive sickness insurance cover in Greece, according to article 7 par. 1 (b) of Directive 2004/38/ΕC. Thus, since the person concerned meets the above mentioned requirements, from 2024 and thereafter, he/she has acquired the right of permanent residence and according to Article 16 par. 1 of Directive 2004/38/EC, he/she is no more subject to any conditions.

  • Those who had acquired the right of permanent residence, when they were issued the residence document for first time at the time o, valid for ten years as permanent resident is not subject to the conditions of non-permanent residence, they should simply prove that the condition of article 15 par. 3 of W.A. has not been violated. This means, they were not absent from the Greek territory for more than five consecutive years during the validity of their residence document. This can be proven by any means, which can establish their entry and residence in the Greek territory during this period.

For example, a UK national was issued a residence document under Article 18 (4) WA at the beginning of 2021 valid for ten years, as a person entitled to permanent residence right. If the applicant applies at the period of the expiry of his/her residence document for its renewal, then a document that simply proves his/her residence in the Greek territory during the period 2021-2026 and one during the period 2026-2031 are adequate for the purpose of non-violation of the term of article 15 par. 3 of the WA and the renewal of his/her residence document.

The application for the renewal of the residence permit can be submitted two months before the expiry date of the previous residence permit. Essentially this provision refers to the cases of renewal of the residence permit valid for ten years.

Holders of a residence permit valid for five years (non-permanent residence), who acquire the right of permanent residence in accordance with articles 15 and 16 of the WA, they may, while their residence permit is valid or at the expiry of it, submit at any time an application for the issuance of a residence permit valid for ten (10) years, providing with the supporting documentation for this purpose.

Ιn the declaratory scheme, that have been chosen by Greece, the holding of the residence document is not a pre-condition of legal residence in the country. Therefore, the expiry of the document or the non-submission or subsequent submission of an application for the renewal of the residence permit, do not affect their residence status in Greece and their right to apply for its renewal later, as well as there are no relevant sanctions. They enjoy their WA rights by the simple fact of fulfilling the conditions set out in the WA.
